Recapsmith respects copyright. Users may only process content they own or have permission to use (see our Terms of Service). We respond to notices of alleged infringement under the U.S. Digital Millennium Copyright Act (17 U.S.C. § 512).

Designated agent

Send copyright notices to our designated agent:

[LEGAL NAME], DMCA Agent [MAILING ADDRESS: a PO box or virtual mailbox works] Email: dmca@recapsmith.com

Filing a takedown notice

Your notice must include all of the following:

  1. Your physical or electronic signature, as the copyright owner or someone authorized to act for them.
  2. A description of the copyrighted work you say has been infringed.
  3. Enough information for us to find the material, such as the Recapsmith link, job ID, or file name.
  4. Your name, mailing address, phone number, and email address.
  5. A statement that you believe in good faith that the use isn't authorized by the copyright owner, its agent, or the law.
  6. A statement that the information in your notice is accurate and, under penalty of perjury, that you are the owner or authorized to act for the owner.

If a notice is valid, we'll remove or disable access to the material promptly and tell the user who submitted it.

Before you file: consider whether the use might be fair use. If you knowingly misrepresent that material is infringing, you may be liable for damages under 17 U.S.C. § 512(f).

Filing a counter-notice

If your content was removed and you believe that was a mistake or misidentification, send a counter-notice to the agent above that includes:

  1. Your physical or electronic signature.
  2. A description of the removed material and where it appeared before removal.
  3. A statement, under penalty of perjury, that you believe in good faith that the material was removed because of a mistake or misidentification.
  4. Your name, address, and phone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you're outside the U.S., any district where Recapsmith may be found), and that you'll accept service of process from the person who filed the original notice.

We'll forward your counter-notice to the person who filed the original notice. If they don't tell us within 10 business days that they've filed a court action, we'll restore the material within 10 to 14 business days of receiving your counter-notice.

Repeat infringers

We count valid notices against each account. If an account gets [3] valid notices that aren't successfully countered, we'll terminate it, and we may terminate sooner in serious cases. We may also remove the option to submit links for any account.
